Help Stop FDA Regulations and Receive a Free 30mL Bottle

Posted on 28 October 2015

What’s at stake

The FDA has submitted their long-awaited final draft of proposed regulations.  As a vaper, if you aren’t scared, you should be.  These regulations are not designed to make vaping products safer, they will wipe out virtually all devices and e-liquid on the market today.  Mods, tanks, RDAs, batteries, juice, and even DIY supplies will vanish.  What’s left?  Big Tobacco’s cigalikes and maybe a handful of products from companies that can throw millions at the FDA.

The details

While we don’t yet have the full details of the final draft, we do know what was initially proposed last year.  The FDA proposed rules that would require any vaping product to go through a premarket approval process that would cost over $300,000 per product.  This is bad for hardware, but worse for e-liquid.  As an example, Vapejoose currently has 85 flavors, 8 nicotine strengths, 4 VG levels and 4 sizes.  That’s 10,880 products, which would add up to well over three billion dollars.  Even with one product, there’s the cost of providing research, testing, and anything else the FDA will require.  In short, there are few if any vendors that will have the slightest chance of surviving.

How do we stop this?

Our best chance is to support H.R. 2058, also known as the FDA Deeming Authority Clarification Act of 2015.  Introduced by Rep. Tom Cole from Oklahoma, this bill would change the grandfather date for “tobacco products” to June of 2015.  Instead of removing 8 years of innovation, only products younger than 4 months will be subject to approval.  Right now, H.R. 2058 is the glimmer of hope we must hold on to.

There has never been a more urgent need for action.  We as individuals, as vapers, as Vapejoose, and as part of this community, urge you to contact the White House, your representative, and your senator.  Tell them your story.  Tell them to support H.R. 2058.  Tell them to do everything in their power to keep vaping alive.  And if you needed another reason, we’ll give you a free bottle for your support.

CASAA has provided a great letter template and information on how to contact your representatives.  After sending them your letter, email it to us at and we’ll give you a coupon code for a free 30mL bottle of Vapejoose e-liquid on your next order.  Make your voice heard now, before it's too late.

I’m glad vapping has gotten bigger. Sorry for Cali the money’s going down but. Less nicotine for the cloud chasers and more flavorful in the long run. Either or vapping is less harmful and who cares if your walking down the street and vapping and hates the cloud and or the smell better then 100 chemicals in your face. You tell me. Ive smoked cigarettes for 2 years and everyday I was coughing up tar. But vaping for 1 and half years has changed my health and my personal ability to work longer, run longer, do more activities. But me personally I love the flavors vapejoose creates. I’d love to get 80/20 3% of one of your special fruity flavors or a good breakfast flavor.

I was an almost 20 year smoker when I switched to vaping. In March of this year I was diagnosed with Acute Myloid Leukemia. My oncologist told me that if I had still been smoking I would not have been able to survive the disease or the treatment. I look at is as vaping helped save my life. My wife has had asthma and heart problems for most of her adult life. Since she started vaping she is has not had an asthma attack or any heart pains. Her health has improved a great deal. Both of us feel that without vaping we would still be smoking and our health would be much worse than what it is, and I may not be alive today to tell you about it.

I was a 25+ year smoker before I started vaping. I’ve sent countless emails to my local government and to the white house. I couldn’t call my local rep by the time I got the email yesterday so I emailed him instead. We need to keep speaking til our voices are heard. There’s no justifiable reason for them to take vaping away.

I only smoked cigarettes for 3 years however, when it was time for me to make A change the vape was there. I have severe asthma however with the vaporizer it doesn’t act up. This is the best thing they put on the market.

Very important. Most people can’t comprehend the fight big tobacco is waging on the vape industry. They are not going to give up and we can’t either.

I used to smoke 3 packs a day but vaping is saving my life, please don’t take that away from us! cigarettes kill you slowly and are addictive everyone knows this.

Scared if I didn’t have vaporing I would go back to smoking and do NOT want to do that! I am so much healthy since I started vaporing and am sooooo happy about that, as I was a smoker for 45 years!
Congress needs to put their attention to more important things that people that vape, like how the world is going to hell in the past 7 years…..just sayin’

I am writing to express strong support for the FDA Deeming Authority Clarification Act of 2015 (H.R. 2058) and urge you to co-sponsor this bill which would amend the Food, Drug, and Cosmetics Act to change the grandfather date for newly deemed tobacco products to the date when the deeming regulation is finalized. If left unchanged, the February 2007 grandfather date would have the effect of removing 99.9% of vapor products (otherwise known as e-cigarettes) currently on the market as soon as the restriction took effect. This would be (i) devastating to small- and medium-sized independent vapor businesses, and (ii) would ban the products that millions of consumers like me use to remain smoke-free.

Only a handful of early generation (not very effective) vapor products were on the market in 2007. The advances made in the industry since that time have produced safer and more effective products and no one currently sells such primitive products. H.R. 2058 makes a reasonable accommodation for newly deemed products to be grandfathered based on the date they are brought under FDA’s jurisdiction. Such a simple clarification of FDA’s authority will allow millions of consumers continued access to a less harmful alternative to combustible tobacco and ensure that thousands of small businesses across the country will be able to continue to contribute to the economy.

As a consumer of vapor products, it is vitally important to me that the variety of quality products currently on the market are allowed to remain on the market. Millions of Americans like me have experienced remarkable and important health benefits by switching to these low-risk, smoke-free products. It should be a public health priority that millions more have access to the same experience.

I look forward to your response on this issue. I, along with my fellow members of CASAA (Consumer Advocates for Smoke-free Alternatives Association), thank you for considering my comments and urge you to support H.R. 2058.

I can not believe all these people want to get there cut of a good thing that is so greedy vaping help a lot of people kick the smoking habit and so went there cut as far as all it cost in taxes and all to smoke

  • Robert Campbell: October 29, 2015

I started vapeing last November, and I have never felt healthier. I am so glad to not have all the chemicals that are in tobacco in my body any longer.

  • Rafael Serrano Jr: October 29, 2015

I dont understand how something that has been helping people quit cigarettes would be under attack by the government that proves that the only thing they care about is not weather vaping is safe but the money they loose when people stop smoking there ridiculously price cancer sticks.

  • R!S: October 29, 2015

I haven’t had a cigarette in over a year now and its entirely to vaping! I went from nearly 2 packs a day, to vaping. Vaped hard for 3 months, and now, I only vape every once and a while. Completely killed the urge to smoke, being around cigarettes now drives me bananas. Vaping is a much better alternative, compared to slowly killing yourself for the fake satisfaction of a hand to mouth habit.

  • Ben Elwell: October 29, 2015

Vaping is not as simple as you may think. As vapor product users, we want choices. Don’t take those away. Vapor products are life-saving and I am LIVING proof. Smoking is dead, vaping is the future and the future is now.

  • Craig Jensen: October 29, 2015

Vaping got me to quit a 45 year smoking habit….Don’t let it stop saving lives.

  • Nate: October 29, 2015

I was a smoker for 17 years. When i started vaping I wasn’t even looking to quit smoking. I enjoyed it. I just wanted something to use in the house because my youngest son kept getting ear infections and they said it was because of secondhand smoke. Once I started vaping I didn’t want a cigarette. I’ve now been cigarette free for 9 months and don’t remember a time when I felt as healthy as I do now. I can breathe better. I can play basketball with my kids without chest pains. Please do whatever it takes to save vaping. Don’t let big tobacco and the FDA take it away drink us.

  • Harrison Heuston: October 29, 2015

  • Charlotte Rhubottom : October 29, 2015

To whom it may concern, I’m begging you to please rethink your ideas on what are tobacco products and what are not.Vaping has been the only solution to my 40 year problem. I had tried everything to quit. Nothing had had worked and I fiercely wanted to live to see my grandchildren grow up and was afraid I wasn’t going to be able to if I didn’t quit smoking. Then I discovered vaping and it worked. I started on 12 mg of nicotine and and am down to to 2-3. The goal is 0 mg.

I took those warnings seriously on the side of the cigarette packs that said smoking with kill me. So I’m trying to do something about it won’t you please help me? Please?

    Thank you
    Charlotte Rhubottom
