Today is August 8th, 2018. And here we are.

Some background: two years ago today, the FDA regulations officially went into effect. New products had to go through the expensive PMTA process (more on this later), which effectively froze the market - US manufacturers could no longer create or modify e-liquid or hardware. They also set several regulatory hurdles for the industry such as product listing, ingredient listing, health document submission, labeling requirements and more. And then, at the end: PMTAs were due, or your product was off the market. That date? August 8th, 2018. Today.

PMTAs (Pre-Market Tobacco Applications) were estimated by the FDA at $300,000 per product. A product is defined in this case by any variant of an item. Let’s use the Vapejoose line for reference:

$300,000 x 75 flavors x 9 nicotine strengths x 3 VG ratios x 3 sizes = $1,822,500,000

Yeah, 1.8billiondollars to apply forjust the Vapejoose line. With no guarantee of approval, as the FDA has been vague about what they want. The PMTA deadline is nothing short of doomsday for the industry as we know it.

Now for some good news - the deadline was pushed back by FDA Commissioner Scott Gottlieb to August 8th of 2022. Four extra years unlesssomething big happens. But in the meantime changes are coming.

SInce the market freeze in 2016, the first real change to affect our customers happens in just two days. On August 10th, 2018, all e-liquid must comply to FDA packaging requirements. 30% of each label will be taken up by warning text:

WARNING: This product contains nicotine. Nicotine is an addictive chemical.

In addition to the warning text, we decided it was time for a full label redesign. Makers of vapor products are being accused of marketing to minors. While we certainly aren’t targeting kids, branding likethis may lead to stricter regulations down the road. We removed the bright colors and food images from our products just to be on the safe side.

If your product isn’t made-to-order you may get older labels or even a mix of old and new as we sell through our inventory. Vapejoose is going to look different, but don’t panic! Your e-liquid is made the same way, with the same ingredients, in the same lab, by the same people. Vapejoose is dedicated to bringing our customers a quality product no matter the challenges.
